ANSWER: “The university couldn’t say it wasn’t true because of FERPA,” said Sullivan, referring to federal student privacy law. “And the only reason I can say it to you now is because there’s a police chief’s report, which is not FERPA-protected.”
She said universities should not “run roughshod over student privacy,” but they are in a difficult spot.
“Universities are put into a position in which we cannot defend ourselves,” she said.
The board of visitors hired a law firm to investigate the university’s handling of the case, she said, and the attorney general’s office sought permission from Education Secretary Arne Duncan to release the executive summary of the report.
“The Department of Education said no,” she said. “We cannot even be transparent about an instance in which we spent taxpayers’ money. We can’t tell you what you got for that.”
