Прелестно: мексиканцы угрожают подать в суд на американцев, если те начнут защищать свои границы. Дескать, если вы охранять будете, то нам придется через разные труднодоступные места лазить и от этого мы сильно пострадаем. И даже мексиканский президент позвонил и выразил озабоченность - как так, его гражданам не позволят рисковать собой, чтобы свалить из Мексики? По-моему, этому президенту следует для начала подумать, как сделать так, чтобы его граждам не было настолько херово в государстве, которое он возглавляет, что они готовы рисковать жизнью, лишь бы из него убраться. Но что-то сообщений о подобных размышлениях я не встречал - видимо, он еще не придумал, как.

Speaking about lawsuits the question is specifically the deployment of National Guard to detain the illegal immigrants, not making crossing more dangerous or whatever.

"If there is a real wave of rights abuses, if we see the National Guard starting to directly participate in detaining people ... we would immediately start filing lawsuits through our consulates," Foreign Secretary Luis Ernesto Derbez said in an interview with a Mexico City radio station.

I don't know what makes using National Guard in this way illegal, but, perhaps, someting does.

The Mexican government doesn't have legal standing in this issue.
The Posse Comitatus Act and its possible violations are the sole business of the United States. It's very generous of the Mexican FM to be concerned about possible violations of our laws, but maybe they should start by worrying about not violating our sovereignty?

My presumption is that when high-ranking Mexican officials says
"we would immediately start filing lawsuits through our consulates,"
he knows that they can do it.

Have you heard of a concept of frivolous lawsuits?
They can start filing them alright. It's just those suits will be thrown out for total lack of legal standing. Again, the Posse Comitatus issue is a matter of the government of the United States complying with the laws of the United States. It doesn't have anything to do with the Vienna Convention, and it doesn't concern the nation of Mexico in any possible way.
On the other hand, with proper judge shopping, who knows? Maybe, tomorrow we'll find out that the U.S. military doesn't have a role in defending the country at all. Everything is possible nowadays.

As I understand the lawsuits planned were to be filed in US courts.
I would suspect if the US government does, presumably, break some US law, one can find somebody to file a lawsuit in US court to this regard.

Well, that's the job of any goverment - protect their citizens where they can. These 'illegals' are their citizens, after all

Sure. The problem is, if the question is whether the U.S. government broke its own law, that "somebody" cannot be a foreign power. That's why Mexican consulates have no standing, no matter how this may upset this cabaliero from their Foreign Ministry. I'm sure ACLU & Co. will be swarming all over it in no time flat, though.

I don't know who can file a lawsuit in US courts (could the detainees themselves do that, since they are on US soil ?), but that's what I meant by that somebody can be found.

I understood what you meant. And somebody will undoubtedly file suits, lots of them. What I'm saying, though, is that the government of Mexico, either from Mexico or in the U.S. through its consulates, can't do it. So, the whole threat from their FM is bogus and is nothing but grandstanding.

Ну это по логике ничем не отличается от вора, который подает в суд на тех, у кого всякие прибамбасы защитные успешно срабатывают. А такие суды, как я понимаю, в Америке уже давно стали общим местом.

А тебя не удивляет, что Израиль поставляет в т.н. автономию электричество, воду и,наверняка, еще много чего? Мексиканцы хотя бы не стремятся уничтожить США, как арабы - нас.
