И даже мексиканский президент позвонил и выразил озабоченность - как так, его гражданам не позволят рисковать собой, чтобы свалить из Мексики? По-моему, этому президенту следует для начала подумать, как сделать так, чтобы его граждам не было настолько херово в государстве, которое он возглавляет, что они готовы рисковать жизнью, лишь бы из него убраться. Но что-то сообщений о подобных размышлениях я не встречал - видимо, он еще не придумал, как.

I don't know what makes using National Guard in this way illegal, but, perhaps, someting does.

The Posse Comitatus Act and its possible violations are the sole business of the United States. It's very generous of the Mexican FM to be concerned about possible violations of our laws, but maybe they should start by worrying about not violating our sovereignty?

They can start filing them alright. It's just those suits will be thrown out for total lack of legal standing. Again, the Posse Comitatus issue is a matter of the government of the United States complying with the laws of the United States. It doesn't have anything to do with the Vienna Convention, and it doesn't concern the nation of Mexico in any possible way.
On the other hand, with proper judge shopping, who knows? Maybe, tomorrow we'll find out that the U.S. military doesn't have a role in defending the country at all. Everything is possible nowadays.

I would suspect if the US government does, presumably, break some US law, one can find somebody to file a lawsuit in US court to this regard.
