Статья в защиту патентов. Любопытный пассаж (речь идёт о патенте Гугля):
Because getting a patent means accepting a time-limited monopoly on your invention, anyone will be able to use this specification to build their own search engine when the patent expires in 2018. In the meantime, you’re free to look at Google’s work and attempt to design around the specific claims in the patent. That’s an important way the patent system encourages innovation, actually: it forces inventors to build alternative ways to do things. You can bet Microsoft’s Bing team has spent hours studying the PageRank patent in an attempt to build something that works differently — and hopefully better.
Первый раз вижу использование broken window fallacy в качестве аргумента о пользе именно патентов. Впрочем, реальность несколько отличается, говорят нам некоторые комментаторы:
Nilay, I think your patent exchange misses a key point in software. No one reads them. Nobody reads patents. In fact, go talk to a Microsoft and Apple engineer about patents and they'll tell you that not only do they not read them, their corporate policy does NOT allow engineers to read patents. Apparently it drastically increases the likelihood of treble damages for the company.
Ну и вообще, аргумент "зато вы в 2018-м году сможете построить свой гугль" поражает своей незамутнённостью. И это при условии, что в 2018-м это произойдёт - все мы знаем, что случилось со сроками копирайтов. А к 2023 году вы сможете использовать linked list с более чем одним указателем - благо, патент на него уже истечёт. А пока - радуйтесь, что вашу креативность стимулируют.
