Despite NSA quadrupling the number of oversight staff after some significant violations in 2009, the oversteps still increased throughout 2011 and 2012.
A Feb. 2012 incident found unlawful retention of more than 3000 files the FISA court ordered the NSA to destroy.

When it is time for the NSA to obtain Fisa court approval, the agency does not tell the court whose calls and emails it intends to intercept. It instead merely provides the general guidelines which it claims are used by its analysts to determine which individuals they can target, and the Fisa court judge then issues a simple order approving those guidelines. The court endorses a one-paragraph form order stating that the NSA's process "'contains all the required elements' and that the revised NSA, FBI and CIA minimization procedures submitted with the amendment 'are consistent with the requirements of [50 U.S.C. §1881a(e)] and with the fourth amendment to the Constitution of the United States'". As but one typical example, the Guardian has obtained an August 19, 2010, Fisa court approval from Judge John Bates which does nothing more than recite the statutory language in approving the NSA's guidelines.

Разумеется, это не работает, когда в дело мешается политика, см. случай Циммермана.
И уж разумеется, совсем плохо оно работает, когда всё в полном секрете, а в деле участвуют люди приученные к многолетнему постоянному вранью и уверенные в своей полной безнаказанности.

Причём эти основания должны фиксироваться и становиться публичными через определённый срок. Отменить ограничения не публикацию факта получения National Security Letter и всех запросов и судебных решений по таким запросам - исключая конкретных лиц и факты, если суд постановит, что это необходимо. Регулярно публиковать официальную статистику этих запросов и результатов, которые они принесли - с именами конкретных пойманных фигурантов и т.п.
Сделать выдачу информации другим агентствам без связи с конкретным расследованием терроризма ведущим к автоматической потере допуска всех ответственных (в случае официального лица, понятно, и увольнению с должности, требующей допуска) на 5 лет в первый раз и навсегда - при повторном случае. Ну и разумеется - враньё конгрессу должно влечь уголовную ответственность для всех, а не только для мелких людишек.

То есть, не "мы хотим читать мейлы Махмуда Али", а "мы сделаем SELECT * FROM ALL_EMAILS_THAT_WE_HAVE_ALREADY WHERE EMAIL_TEXT LIKE '%OBAMA%BOMB%', а потом будем читать почту всех кого вытащит наш селект, а также тех с кем они переписывались, а также тех кто переписывался с теми с кем они переписывались" или что-то в этом духе.

50 лет много, а 10, скажем, вполне. Если дополнить это реальными наказаниям за абьюз - то через 10 лет прищучить вполне реально.

10 лет - очень мало. Многие "игры" спецслужб продолжаются десятилетия.
Слив такой информации может поставить под угрозу еще действующих агентов

В принципе, подобные решения принимаются на уровне правительства. Суд может только определить антиконстуционно это или нет.
