Т.е. теоретически, конечно, это таинственное обьявление может значить, что они решили расследовать китайские сделки Хантера или, horible dictu, институты Конфуция - но это же Гарланд. Так что почти наверняка калюжен. Может, у них уже и новое досье есть... 

А вот новости юриспруденции. Пейдж подал в суд за незаконную слежку над ним, и суд ему отказал. По следующим причинам:

1. Ложь в документах FISA не может быть основанием для иска частного лица. Т.е. против вас могут подать полностью фальшивый афидавит, и мало того, что у вас, естественно, нет никаких прав опровергнуть его по ходу дела - даже если потом выясняется, что это фальшивка, причём заведомая и намеренная, у вас по-прежнему нет никаких прав ни на что. Удобненько, а? Дальше - лучше.

2. Вообще нет закона, позволяющего частному лицу требовать чего-либо по суду от правительства за незаконную слежку. Ну следили, ай-яй-яй, всё пох, гуляй Вася, никаких прав у тебя нет. Правительству достаточно произнести магические слова "национальная безопасность", и оно может делать всё, что угодно - без всякой ответственности.

3. Поскольку правительство США является сувереном, то нужен специальный закон Конгресса, устанавливающий случаи, когда против него можно подавать в суд. Поскольку Конгресс не установил, что можно подавать за незаконную слежку на основании заведомо фальшивых свидетельств, сфабрикованных политическими оппонентами - то и суда нет. Привет, гуляй.

Заметим, кстати, что директор Врай "извинился" перед судом FISC за фальшивки и ложь. А перед Пейджем даже извиниться за преступления, совершенные против него - неа, не нужно. Не то, чтобы помогло - но и не заслужил. Правильно, кто он такой - лох, плебей - ФБР имеет законное право чморить его, как хочет. Никакой ответственности никто за это не понесёт - и всё по закону.

В далеком 2016-м я задал по поводу истории с Альфа-Банком несколько вопросов. Теперь я могу на них ответить. Привет тебе, Стас из 2016-го. Слушай сюда! Во-первых, закупай биткойны. Во-вторых - вот ответы на твои вопросы:

1. Каким образом люди, именуемые scientists, получили доступ к логам серверов, им не принадлежащих и информацию о запросах чужих серверов? Моя рабочая гипотеза об этом пока сильно не радует, но, возможно, есть какое-то обьяснение, которое я упускаю и которое делает историю менее пугающей.

Всё просто. Кампания Клинтон выделила бюджет под раскрутку идеи, что Трамп - марионетка Путина. Всю судьбу этого бюджета мы прослеживать не будем, для этого надо писать многотомный роман, но одна из частей его отправилась к человеку по имени Майкл Суссман. Этот человек переговорил с неким Tech Executive 1, и они нашли общий язык. Далее TE1 собрал друзей и прочитал перед ними речь. Что-то типа: "Чуваки! Фашизм наступает, и мы должны спасти страну. Вы, как представители частного капитала, не можете остаться глухим к стонам народа. Отовсюду мы слышим стоны.  Со всех концов нашей обширной страны взывают о помощи. Мы должны протянуть руку помощи, и мы ее протянем. Поскольку мы владеем большинством интернет-инфраструктуры страны, через наши серверы идут все данные, которые передают компании Гитлера... т.е. я имел в виду, Трампа. И мы должны найти в них что-нибудь, что позволит нам заявить, что Трамп - ставленник Москвы, и мы это найдём!". И всё заверте...

2. Является ли для них такой доступ нормальным, рутинным делом и нормально ли для них использовать его в целях накопать компромат на кандидата в президенты? Существуют ли какие-либо этические ограничения при доступе этих людей к этим данным?

Я не знаю, являлось ли такое рутинным делом до 2016-го. Но я знаю, что абсолютно никаких этических ограничений в борьбе с Трампом у Лучших Людей нет, и быть не может. Какие могут быть ограничения, когда они борются с фашизмом и Гитлером? Абсолютно ничто для них не слишком, и никакие действия, в нормальной обстановке считающиеся неэтичными и даже преступными - не являются для них проблемой или даже основанием для сомнений, когда речь заходит о партийной борьбе. Если вам в голову приходит "нет, ну на это они не пойдут, это уже слишком" - забудьте об этом, пойдут. И да, теперь это - норма. 

3. Как получилось, что люди, которых автор называет malware hunters, занялись чем-то, весьма далёким от hunting malware?

Очень просто. Бюджет им выделяли действительно под malware и прочие интересные вещи. Но к ним пришли их знакомые и друзья, и сказали - надо немного поработать ради святой цели. К чему ваша возня с малварью, если в стране будет править Гитлер? Родина важнее профессиональных обязанностей и бюджетов! И они охотно согласились, и подписались на проект ради благой цели. 

4. Как именно организован описанный в статье широкомасштабный сбор данных из логов DNS, какие есть ограничения на доступ к ним и каким образом обеспечивается, чтобы доступ к этим логам не был использован для целей, не имеющих ничего общего с борьбой против киберпреступности и т.п.?

Да очень просто организован - просто пошли и открыли те самые логи, которые провайдеры собирают для технических целей, и передали их "исследователям", чтобы те копали компромат. Никаких ограничений в этом случае не надо было, цель святая, какие могут быть вопросы?! Разумеется, никаких вопросов о том, что логи используются нецелевым образом, не было - все, кто мог задавать эти вопросы, были в деле, и для них этот образ был самым что ни на есть целевым. Просто в 2016-м мы ещё не знали, как охотно крупный бизнес предпочтёт партийные нужды - нуждам деплораблей. Теперь мы это знаем уже довольно хорошо. 

5. Какова в этом деле роль Paul Vixie?

Это единственный вопрос, по поводу которого у меня нет стопроцентной ясности. Теоретически, возможна ситуация, что его попросили знакомые подписаться под этим, и он решил оказать услуги, долго не задумываясь. Но скорее всего, с ним произошло ровно то, что произошло с десятками, если не сотнями, других экспертов за последние пять лет - он решил, что пришёл момент, когда надо использовать свою репутацию Для Блага Человечества. По крайней мере очевидно, что никакой профессиональной экспертизы от него не требовалось - всё было полным враньём с самого начала, и все участники знали, что они ничего не ищут, а стряпают фальшивку. Надо было лишь найти кого-то с внушительным именем, который бы под этой фальшивкой подписался.
Раньше мы считали, что экспертам такое поведение - сжечь свою репутацию, как пожертвование на алтарь политики - не свойственно, репутация-то одна. Но теперь, в 2022-м, мы знаем, что это совершенно не так. Эксперты, оказывается, легко и охотно врут нам в лицо, если считают, что дело того стоит. Мало того, после этого значительная часть публики - не вся, но очень многие - продолжают считать их экспертами с нетронутой репутацией, даже когда становится известно, что они намеренно врали, причём открыто упирая на свою репутацию эксперта в качестве доказательства, что они не станут врать. А это враньё - ну так это Совсем Другое Дело. Такова теперь норма, надо учиться жить в этом дивном новом мире. 

А вот документик (да, не новый, но мне захотелось его обсудить именно сейчас):



Из него мы видим, что все спецслужбы и вся верхушка демократов уже к осени 2016 знали, что калюжн - фальшивка, состряпанная по заказу кампейна Клинтон (да, и бидон, конечно, тоже знал).

Т.е. когда все эти ребята читали трескучие речи о русской угрозе и о том, как надо всё тщательно расследовать - они все, все до единого, знали, что это всё враньё. Не просто там подозревали Трампа и не имели доказательств, не просто стремились что-то выжать из недоказанных обвинений и слухов - они доподлинно знали, что всё фальшивка, ещё до задолго того, как назначили Мюллера. И Мюллер, в самый момент своего назначения, уже абсолютно точно знал, что всё, что он "расследует" - фальшивка. Не "нет свидетельств", не "недоказано", не "недостоверные сведения" - а заранее, заведомо известно, что это выдумано, кто это выдумал и зачем. Теперь можно просто пересматривать и перечитывать всё, что тогда происходило, зная доподлинно то, что тогда мы только подозревали - что все эти люди знают, что каждое слово, которое они произносят и пишут - полное враньё. 

И ещё один интересный момент, на который стоит обратить внимание. Верхушка демократов всё знала, но рядовые мандавошки, я думаю, в значительной мере думали, что там действительно что-то расследуют и подозревают. Теперь им доподлинно известно, что всё, что они слышали за последние 5 лет - основано на циничной манипуляции, что все их благородные порывы и пыл в защиту страны от путинского вмешательства - всё это дурацкие танцы марионеток на верёвочках, за которые дёргают бесстыдные лжецы. Вот этим всем яковам, которые 5 лет яростно дрочили на калюжен, орали Hello! и жили в надежде, что вот-вот раскроются врата и на них прольётся Свет Правды - им ничуточки не обидно, что их так откровенно наебали? Никто из них не возмутился, что их кормили враньём несколько лет, а они в это всё верили?

Нет, ну я не скажу, что совсем никого нет - пару человек, наверное, вроде Гринвальда, найдётся, у которых возникли разногласия с партией по этому вопросу. Может, десяток-другой диссидентов наберётся. Но основные партийные массы - сожрали ведь, причмокнули и не высказывают абсолютно никакого недовольства вторичностью продукта. Не то, чтобы ожидалось многого от партийных драчков, но даже от могучих интеллектуалов, парящих в высотах своего рационализма и любящих презрительно обьяснить копошащимся внизу идиотикам, как обстоят дела На Самом Деле - что-то не слышно возмущений и каких-то выводов.

И, кстати, тут полезно упомянуть и республиканцев, которые мямлили "да, мы бы поддержали Трампа, но такие серьёзные обвинения, надо тщательно расследовать... мы не можем игнорировать наших бравых ребят из спецслужб..." Всё вот эти штопаные гандоны, теперь, когда они знают, что их развели, как лохов - их это чему-то научило? Думаю, ничему, к сожалению.
